Privacy Policy

1. Data controller

The controller of your personal data is Grzegorz Bergmann, trading as bergmann.studio, ul. Kombatantów 3B/10, 80-464 Gdańsk, Poland, registered in Poland under tax ID (NIP) 5842622609 and statistical number (REGON) 388593752. 2. What data I collect and why

You provide data voluntarily by filling in the contact form. I collect your name, email address and message, and optionally your company name, a rough budget, the services you need and how you heard about me.

• Replying to your inquiry and preparing a quote (legal basis: Art. 6(1)(b) GDPR, steps taken towards a contract). This is not marketing.
• Preventing abuse of the form (legal basis: Art. 6(1)(f) GDPR, my legitimate interest in protecting against spam).

3. Who I share data with

I use external providers who process data on my behalf under data processing agreements:

• HubSpot, Inc. (the CRM where I store your inquiry). Data may be transferred to the US under an adequacy decision (Data Privacy Framework) and standard contractual clauses.
• Resend (Plicmd, Inc.) (sending emails: your confirmation and my notification).
• Vercel, Inc. (site hosting and form handling).

I do not sell your data and do not pass it to third parties for marketing purposes.

4. How long I keep data

I keep correspondence data for as long as needed to handle your inquiry, and if it leads to a project, for the duration of our collaboration plus the period required by law (e.g. accounting). If we don't end up working together, I delete the data within 24 months of the last contact, unless you ask for earlier deletion.

5. Cookies and analytics

The site does not set any analytics or marketing cookies by default. I only run analytics (Google Analytics 4, loaded via Google Tag Manager) once you give consent in the cookie banner. Until then, Google's scripts are not loaded.

• Legal basis: your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time by clearing the site's data in your browser or writing to hello@bergmann.studio.
• Purpose: anonymous traffic statistics that help me improve the site. I use Google's Consent Mode, so no analytics data is collected until you accept.
• Recipient: Google Ireland Ltd. / Google LLC. Data may be transferred to the US as described in section 3.

Regardless of consent, I use cookies necessary for the site to work (e.g. remembering your cookie banner choice). These are essential and don't require consent.

6. Your rights

Regarding the processing of your data, you have the right to:

• access your data and get a copy,
• rectify inaccurate data,
• erasure of your data,
• restrict processing,
• object to processing,
• data portability,
• withdraw consent at any time (without affecting the lawfulness of processing before withdrawal).

You also have the right to lodge a complaint with the Polish Data Protection Authority (Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw, Poland) if you believe I'm processing your data unlawfully.
