We care about the security of your personal data. 6. For what purposes do we process your personal data?

There are several purposes. Below is their list, followed by a more detailed discussion. We have also assigned appropriate legal bases for processing to individual purposes.

• correspondence handling - Art. 6 (1)(f) GDPR,• order processing - Art. 6 (1)(b) GDPR,• fulfillment of tax and accounting obligations - Art. 6 (1)(c) GDPR,• creating an archive for the possible need to defend, establish or pursue claims, as well as for the purpose of identifying a returning client - Art. 6 (1)(f) GDPR,• own marketing - Art. 6 (1)(f) GDPR,• analysis, statistics and optimization - Art. 6 (1)(f) GDPR.

Correspondence handling - details

By contacting us, you naturally provide us with your personal data contained in the content of the correspondence, in particular your email address and name and surname. Providing data is voluntary, but necessary to establish contact.

Your data is processed in this case for the purpose of contacting you, and the basis for processing is Art. 6 (1)(f) GDPR, i.e., our legitimate legal interest. The legal basis for processing after the end of contact is also our justified purpose in the form of archiving correspondence for the purpose of ensuring the possibility of demonstrating certain facts in the future (Art. 6 (1)(f) GDPR).

The content of correspondence may be archived and we are unable to clearly determine when it will be deleted. You have the right to demand the presentation of the correspondence history you conducted with us (if it was archived), as well as to demand its deletion, unless its archiving is justified due to our overriding interests, e.g., defense against potential claims from you.

Tax and accounting obligations - details

If we issue an invoice for you, it becomes part of the accounting documentation, which will be stored for the period of time required by law. Your personal data is processed in such a situation for the purpose of fulfilling our tax and accounting obligations (Art. 6 (1)(c) GDPR in connection with provisions regulating tax and accounting obligations).

Archive - details

Within the description of individual purposes of personal data processing above, we indicated the terms for storing personal data. These terms are often related to our archiving of certain data for the purpose of ensuring the possibility of demonstrating certain facts in the future, reconstructing the course of cooperation with the client, correspondence exchanged, defense, establishment or pursuit of claims. We rely in this regard on our legitimate legal interest referred to in Art. 6 (1)(f) GDPR.

Own marketing - details

Our site may collect information about your activity and based on this display targeted advertisements to you while browsing the Internet. However, if you are not a registered user, the information used for this purpose is not personal data. Only when they are combined with your personal data collected in the user account do they acquire the character of personal data.

We carry out the activities described above based on our legitimate legal interest referred to in Art. 6 (1)(f) GDPR consisting of marketing our own products.

Analysis, statistics, optimization - details

We collect statistical information about user behavior while browsing our websites, such as clicks on links, transitions between subpages, time spent on individual pages, etc. We analyze this information to optimize our sites for user experience, effectiveness and conversion. In most cases, information processed in this way is not personal data. The exception is the situation where you are a registered user. Then we can combine this information with your other data collected in the user account.

We carry out the activities described above based on our legitimate legal interest referred to in Art. 6 (1)(f) GDPR consisting of optimizing our websites.

7. How long will we store your personal data?

Data retention periods have been indicated separately for each purpose of processing. You will find this information within the details devoted to each separate purpose of processing.

8. Who are the recipients of your personal data?

We'll venture to say that modern business cannot do without services provided by third parties. We also use such services. Some of these services involve the processing of your personal data. External service providers who participate in the processing of your personal data are:

• hosting provider that stores data on the server (Netlify),• cloud computing service provider where backups that may contain your personal data are stored,• mailing system provider where your data is stored if you are a newsletter subscriber,• CRM system provider where we store your data to streamline customer service and for archival purposes,• billing system provider where your data is stored for invoicing purposes,• accounting office that processes your data visible on invoices,• law firm that gains access to data if it is necessary to provide legal assistance on our behalf,• entity providing technical support services that gains access to data if technical work concerns areas where personal data is located,• other subcontractors who gain access to data if the scope of their activities requires such access.

Your personal data may also be transferred to tax offices to the extent necessary to fulfill tax-accounting-bookkeeping obligations. This concerns in particular all declarations, reports, statements and other accounting documents containing your personal data.

In addition, if such a need arises, your personal data may be made available to entities, bodies or institutions authorized to obtain access to data based on legal provisions, such as police services, security services, courts, prosecutors.

Moreover, we use tools that collect a range of information about you related to using our site. This concerns, in particular, the following information:

• information about the operating system and web browser you use,• pages viewed,• time spent on the site,• transitions between individual subpages,• clicks on individual links,• source from which you come to our site,• age range you are in,• your gender,• your approximate location limited to locality,• your interests determined based on online activity.

This information itself does not, in our assessment, constitute personal data. Since this information is collected by external tools we use, this information is also processed by tool providers on the basis of their terms and privacy policies. Basically, this information is used to provide and improve services, manage them, develop new services, measure advertising effectiveness, protect against fraud and abuse, as well as personalize content and advertisements displayed in individual services, websites and applications.

9. Do we transfer your data to third countries or international organizations?

Yes, some personal data processing operations may involve transferring them to third countries.

We transfer your personal data to third countries in connection with the use of tools that store personal data on servers located in third countries, particularly in the USA. Providers of these tools guarantee an appropriate level of personal data protection through appropriate compliance mechanisms provided by GDPR, particularly through joining the Privacy Shield program or using standard contractual clauses.

Data storage on servers located in third countries occurs within the following tools:

• hosting services provided by Netlify, Inc. - for all data processed within Netlify services, including data contained in files synchronized with Netlify

Netlify, Inc. ensures an appropriate level of personal data protection by applying compliance mechanisms provided by GDPR.

10. Do we use profiling? Do we make automated decisions based on your personal data?

We do not make decisions about you based solely on automated processing, including profiling, that would produce legal effects concerning you or similarly significantly affect you.

We do use tools that may take certain actions depending on information collected through tracking mechanisms, but we believe these actions do not significantly affect you because they do not differentiate your situation as a client, do not affect the terms of the contract you may conclude with us, etc.

Using certain tools, we may, for example, target personalized advertisements to you based on previous actions you took on our site or suggest products that may interest you. This is so-called behavioral advertising. We encourage you to deepen your knowledge about behavioral advertising, particularly regarding privacy issues. Detailed information, along with the ability to manage behavioral advertising settings, can be found here: http://www.youronlinechoices.com.

We emphasize that within the tools we use, we do not have access to information that would allow us to identify you. The information we're talking about here includes, in particular:

• information about the operating system and web browser you use,• pages viewed,• time spent on the site,• transitions between individual subpages,• source from which you come to our site,• age range you are in,• your gender,• your approximate location limited to locality,• your interests determined based on online activity.

We do not combine the information indicated above with your personal data contained in our databases. This information is anonymous and does not allow us to identify you. This information is stored on servers of providers of individual tools, and these servers can most often be located around the world.

11. What rights do you have regarding the processing of your personal data?

GDPR grants you the following potential rights related to the processing of your personal data:

• right of access to your data and receiving a copy of it,• right to rectify (correct) your data,• right to erasure of data (if you think there are no grounds for us to process your data, you can request that we delete it),• right to restrict data processing (you can request that we limit data processing only to its storage or performing actions agreed with you, if in your opinion we have incorrect data or process it without grounds),• right to object to data processing (you have the right to object to data processing based on legitimate interest; you should indicate a particular situation that in your opinion justifies cessation of processing by us covered by the objection; we will stop processing your data for these purposes, unless we demonstrate that the grounds for our data processing are overriding over your rights or that your data is necessary for us to establish, pursue or defend claims),• right to data portability (you have the right to receive from us in a structured, commonly used, machine-readable format the personal data you provided to us based on a contract or your consent; you can commission us to send this data directly to another entity),• right to withdraw consent to personal data processing, if you previously gave such consent,• right to lodge a complaint with a supervisory authority (if you find that we process data contrary to law, you can file a complaint in this matter with the President of the Personal Data Protection Office or another competent supervisory authority).

The rules related to the implementation of the rights indicated above have been described in detail in Art. 16-21 GDPR. We encourage you to familiarize yourself with these provisions. For our part, we consider it necessary to explain to you that the rights indicated above are not absolute and will not apply to you in relation to all personal data processing activities.

We emphasize that one of the rights indicated above is always available to you - if you believe that we violated personal data protection provisions when processing your personal data, you have the possibility to lodge a complaint with a supervisory authority (President of the Personal Data Protection Office).

You can also always contact us with a request to provide you with information about what data we have about you and for what purposes we process it. It's enough to send a message to hello@bergmann.studio. However, we have made every effort to ensure that the information of interest to you is comprehensively presented in this privacy policy. You can also use the email address above for any questions related to the processing of your personal data.

Remember that disabling or restricting cookie support may make it impossible to use parts of the functions available on our site and cause difficulties in using our site, as well as many other websites that use cookies. For example, if you block cookies from social media plugins, buttons, widgets and social functions implemented on our site may be unavailable to you.

14. Can you disable cookies?

Yes, you can manage cookie settings within your web browser. You can block all or selected cookies. You can also block cookies from specific sites. At any time, you can also delete previously saved cookies and other site and plugin data.

There are also browser plugins available that allow control over cookies, such as Ghostery (https://www.ghostery.com). Cookie control options may also be provided by additional software, particularly antivirus packages, etc.

In addition, tools are available on the Internet that allow control over some types of cookies, particularly for collective management of behavioral advertising settings (e.g., www.youronlinechoices.com/, www.networkadvertising.org/choices).

Remember that disabling or restricting cookie support may make it impossible to use parts of the functions available on our site and cause difficulties in using our site, as well as many other websites that use cookies.

15. For what purposes do we use our own cookies?
